SOCIAL VALUE OF POSITIVE LEGAL LIABILITY OF PUBLIC OFFICIALS IN EU COUNTRIES

Abstract
The article contans the research of matters of the positive legal liability of public officials. The author showed its legal nature, social value, highlighted its features and compared it to the retrospective liability. It is substantiated that the positive legal liability of public officials is not sufficiently elaborated by the legal doctrine, what resulted in the imperfection of its le- gal basis. Using the best practices of EU member states the directions of development of scientific thought and legislation about it were indicated.
