Specific results of research of forms of realization of criminal responsibility for evasion from conscription

Abstract
The forms of realization of criminal responsibility for evasion from the conscription were investigated, on the basis of which justified changes to the sanction of Art. 336 of the Criminal Code of Ukraine. Art. 336 "Evasion from conscription" consists of one of the smallest dispositions of the Special Part of the Criminal Code of Ukraine, which completely duplicates the title of the article, and the sanction is without alternative - punishable by imprisonment for a term of two to five years. It was established that one type of punishment in the form of imprisonment in the sanction of Art. 336 of the Criminal Code of Ukraine is clearly not sufficient for the implementation of the functions of criminal law and punishment imposed, in order to fulfill the objectives of the criminal law. Moreover, the use of non-alternative deprivation of liberty and "total" exemption from his trial by force compel the courts to apply Art. 69 of the Criminal Code of Ukraine. Proposed to the sanction of Art. 336 of the Criminal Code of Ukraine to make changes and addenda - to provide for a significant amount of a fine (from one to five thousand non-taxable minimum incomes of citizens) – to make the commission of this crime materially disadvantageous - you do not want to serve - to pay a fine. Public works should be foreseen in order to make the crime morally disadvantageous. An alternative to deprivation of liberty for a term up to five years should be punishment in the form of a restriction of freedom for the same term. It is stated that the prospective direction of further studies is the investigation of other forms of criminal responsibility for evasion from the call for mobilization - exemption from criminal liability for this crime and release from punishment and his serving.
