СПЕЦИФІКА АДМІНІСТРАТИВНИХ ПРОЦЕДУР У СФЕРІ ОХОРОНИ ЗДОРОВ’Я (НА ПРИКЛАДІ РЕЄСТРАЦІЙНИХ І ДОЗВІЛЬНИХ ПРОЦЕДУР)

Abstract

The author of the article has analyzed modern theoretical developments of the essence and content of administrative procedures, which are characterized by the presence of a set of stages and phases, the number and content of which depend on each individual procedure. The author has defined the range of participants of administrative procedures, including executive agencies and other individuals or legal entities, as well as the features of these procedures depending on their type and scope of realization. It has been established that administrative procedures provide the execution of activities of the subjects of management (executive authorities) related to the consideration and resolution of administrative cases and conclusion of administrative agreements, regulated by the norms of national legislation, which is aimed at ensuring the functioning of a particular sphere and facilitating the realization of human rights and freedoms. For its part, specific features of administrative procedures in the health care sphere are considered by the example of studying the process of introduction of registration and licensing procedures. It has been concluded that administrative procedures in the health care sphere, along with the common features, characteristic for all administrative procedures, have their own specific features, which are mainly reflected in objects, items and content. The procedure of legal regulation of administrative procedures has been considered; the author has emphasized that implementation of practically every administrative procedure takes place in accordance with the provisions of separate legal acts, which in most cases require the implementation of a set of concrete actions. The similarity of the process of implementation of administrative procedures in the health care sphere, the plurality of legal acts regulating their implementation, and the presence of mainly the same key participants indicates the need for unification of legal acts regulating the implementation of certain types of administrative procedures, including procedures of registration and licensing.
