ПРОЦЕСУАЛЬНИЙ СТАТУС СПЕЦІАЛІСТА, ЗАЛУЧЕНОГО ДЛЯ УЧАСТІ В КРИМІНАЛЬНОМУ ПРОЦЕСІ

Abstract
Some scientific-theoretical and procedural issues about the procedural status of the expert in the criminal proceedings of the Republic of Azerbaijan are reviewed in this article. For this purpose, the comparative study of criminal-procedural legislation of the countries such as Russian Federation, Kyrgyzstan, Belarus, Kazakhstan, Moldova is investigated. As another participant in the criminal proceedings the different features between an expert and a specialist are systematized and main procedural features characterizing the specialist are indicated. The comparative investigation of regulating statutes and separate norms about the issues on the participation of the procedural figure as an expert in the execution of criminal judgment in the Criminal Procedural Codes of the Republic of Azerbaijan accepted in different periods of time (especially criminal procedural codes dated in 1961 and in 2000) is analyzed. Finding solution ways of scientific-theoretical and tactical-procedural issues about the participation of the expert in the criminal proceedings as well as, the promotion of the efficiency of the institute of the expert`s participation in the different periods of criminal procedure, the legal status of the expert, his participation forms, recommendations about the correct apply of the procedural statutes in the judicial investigation experience and directed offers to the development of the regulating criminal-procedural norms for realizing issues of this procedural status in separate investigative actions and common criminal procedure are largely discussed in this article.
