STATE OF FUTURE LAWYERS’ FORMATION OF AN INFORMATIVE AND COMMUNICATIVE COMPETENCE

Abstract

The article reviews the criteria, indicators and levels of formation the future lawyers’ informative and communicative competence. Thematic justification of the article is determined upon pedagogical and social significance of the problem of future lawyers’ educating insofar as the role of the legal profession in modern society is undoubtedly appreciable. This profession is extremely important for our state, because nowadays in the course of the process of state building and making laws of Ukraine preeminently lawyers are laid hopes on confirming the supremacy principle of law, improvement Ukrainian legislation, strengthening of legal safeguards concerning the protection of various strata of the people and increasing legal awareness and legal culture of the Ukrainian citizens. The complexity and specialized nature of legal cases determine the specific requirements for educating and experience the lawmen, because taking conduct of a legal case means to investigate and analyze actual information, legal elements of the problem, the use of appropriate methods and procedures adequate preparation corresponding the appropriate standards of the legal profession. The content of the legal profession is complex, multicomponent system of activities, including the integral components such as an interaction with the participants of legal relations and direct communication with people in conditions of information saturation. Thus, the formation of an informative and communicative competence of future lawyers is one of the important tasks that each legal educational establishment should set as a predominant task while educating the specialists in the field of law combining traditional and innovative teaching methods for effective implement of an educational and managerial impacts of training activities, improving the traditional forms of training organization and also projecting a higher legal education on a new competency basis. Having analyzed a number of psychological and pedagogical sources we arrived at the conclusion that despite the availability of scientific works on the problem of professional competence and professional generally, informative and communicative competence in particular, the problem of informative and communicative competence of lawyers is not reflected in psychological and pedagogical literature. We defined such criteria of an aforementioned competence as motivational volitive, gnoseological, operational and axiological. Each criteria has determinate indicators. Pronouncedness of each indicator taken together defines the level of formation the future lawyers’ informative and communicative competence. We emphasised four levels of its formation— high, sufficient, middle and low. On the basis of abovementioned criteria, indicators and levels an ascertaining experiment was carried. It showed that overwhelming majority of students doesn’t have high and sufficient level of an informative and communicative competence formation. This proves that traditional approach to an educational process doesn’t provide formation of an informative and communicative competence of future lawyers on a sufficient level. The analysis of the ascertaining experiment confirms the worthwhileness of further research in this field and seeking of optimum methods and ways of future lawyers’ educating and formation their informative and communicative competence.
