СТРУКТУРА ТА ЗМІСТ ЗБИРАННЯ ДОКАЗІВ ЯК ЕТАПУ ЇХ ФОРМУВАННЯ ПІД ЧАС КРИМІНАЛЬНОГО ПРОЦЕСУАЛЬНОГО ДОКАЗУВАННЯ

Abstract
The article is devoted to the research of the collection of evidences as a stage of their formation during the criminal procedural proof. The generalization of the positions of the scholars, who turned to the problems of the collection of evidences in the criminal proceedings, testifies to giving them an independent meaning to the stages of gathering evidences: the detection, the search, the fixing, the documenting, the demanding, the extracting, the storing (preserving). Depending on the author’s approach to the definition of the structure of criminal procedural proof, scientists use the above stages in different combinations and often put in them different content, which necessitates the disclosure of each of them. The content of the stages of the collection of evidences, offered by the scientists, is revealed: the detection, the search, the fixing, the documenting, the demanding, the extracting, the storing (preserving). Based on the analysis of theoretical concepts, the expediency of separation in the structure of the collection of evidences of two parts has been substantiated: 1) the obtaining of the evidences (during the pre-trial investigation – by the sides of the criminal proceedings by means of the methods, specified in part 2–4 article 93 of the CPC of Ukraine, and during court trial – by the court as a result of judicial proceedings, provided in articles 332, 333, 351–361 of the CPC of Ukraine); 2) the fixing of the evidences. Taking into account the combination in criminal procedural proof of cognitive and identity activities, the obtaining of evidences serves as the cognitive side of the of activity of subject of proof and their fixing – as its identity side. In aggregate, the obtaining and the fixing of evidences allows to fully disclosing the content of the collection of evidences as a stage of their formation during the criminal procedural proof. Separation in the structure of the collection of evidences of other parts is superfluous, since they are covered by the content of the indicated stages (the detection, the search, the documenting, the demanding, the extracting of evidences) or are not the part of the structure of criminal procedural proof (the storing of evidences).
