SYSTEM OF PENITENTIARY DIRECTION GOVERNING IN THE STRUCTURE OF JUSTICE BODIES: FOREIGN EXPERIENCE AND DOMESTIC REALITIES

Abstract
In the article, on the basis of generalization of foreign experience of the system of justice bodies functioning, the fact of rather common practice of organizational connection of Justice and Penal Service is established. It is also revealed, as the majority of foreign practices shows, the existence of separate structural units that directly govern the Penitentiary sphere. Also, the study found out, that direct governing by the Ministry of Justice is not typical for world practice. The issues of direct responsibility of the Ministry of Justice of Ukraine for the direction of execution of criminal punishments, the system of institutions for persons’ detention and Probation are raised in the article. Attention is drawn to the need for a detailed analysis of the system of penitentiary direction governing in the Justice System.
