Abstract
In the article the theoretical and legal principles of the procedure of realization of the arrested immovable property through electronic trading are researched. It was established that imposition of arrest on real estate of the debtor is not yet a guarantee of satisfaction of the creditor’s claims. These requirements are met at the expense of funds that are actually received from the sale of the debtor’s property. A comprehensive analysis of these norms gives grounds for the following conclusion: if the amount to be recovered is more than 20 times the minimum wage, then in such a case the foreclosure of the debtor’s real estate, including the debtor’s living space, as well as the land plot , on which housing is located. Real estate is realized only on electronic trades, while it should be added that even the value of such property does not affect the way of implementation. The realization of real estate is the exclusive right of the state or private executor. In addition to these two entities, no one else is authorized to engage in such activities. An appeal against the deity’s immovable property, which may violate the rights and legitimate interests of children, remains unresolved in the legal field, as without the consent of the guardianship and guardianship authority, the executor will not find actual support from the court, as otherwise it will violate a number of principles, which are related to the protection of children’s rights. And in the case of a decision of the court, positive for the executor, inevitably his appeal.
