The Conservative Approach Toward Islamic Human Rights

Abstract

Since the ratification of UDHR, Many steps have been passed, to universalize it, and religions and schools have been necessitated to take their position about it. Islamic trends and thinkers, also, have been considered it form different perspectives and approaches that, "Islamic human rights" is among the most prominent and current of them. Although within different discourses, this idea has been interpreted differently and includes many conceptions, but its conservative interpretation has the most contradiction with modern human rights. This approach seeks to find an especial formulation of human rights, which is compatible with traditional view of Islamic teachings and values. This approach has been relied on several premises that, religious human rights is the most important of them. This article tries to analyze the conditions for possibility of this doctrine and difficulties which is faced with them. From this article's point of view, Islamic human rights, in its particularistic and conservative meaning, which has district and clear distinction with the accepted sense of human rights in the modern world, is a self- contradicted doctrine. چکیده از هنگام تصویب اعلامیه جهانی حقوق بشر گام‌های بسیاری در راستای فراگیرشدن آن برداشته شده و ادیان و مکاتب ناگزیر از موضع گیری در برابر آن شده‌اند. جریان‌های فکری اسلامی و اندیشمندان مسلمان نیز با رویکردهای متفاوتی به این پدیده نگریسته و آموزه‌های گوناگونی را طرح کرده اند که حقوق بشر اسلامی یکی از رایج‌ترین و برجسته‌ترین آن‌ها است. هرچند این آموزه در چارچوب گفتمان‌های مختلف، معناها و تفسیرهای متفاوتی یافته است و طیفی گسترده از برداشت‌ها را در برمی‌گیرد ولی تفسیر محافظه کارانه از آن بیشترین ناسازگاری را با حقوق بشر مدرن دارد. این رویکرد درپی ارائه صورتبندی خاصی از حقوق بشر است که با برداشت‌های سنتی از تعالیم و ارزش‌های اسلامی سازگار باشد. این تفسیر بر پیش فرض‌هایی استوار است که مهم‌ترین آن‌ها امکان حقوق بشر دینی است. نوشتار حاضر در پی تحلیل شرایط امکان این آموزه و دشواری‌هایی است که فرا روی آن وجود دارد. از دیدگاه این نوشتار حقوق بشر اسلامی در معنای خاص گرایانه و محافظه کارانه اش که مرز‌های جدی و روشنی با برداشت پذیرفته شده از حقوق بشر در جهان مدرن دارد، با ناسازواری روبرو است.
