THE DEROGATIONS OF THE RIGHT TO PRIVACY

Abstract
The article is devoted to elucidate upon the derogations of the right to privacy. Such patterns descend from United States cases, as English law does not recognize a common law right to privacy as a separate right. The author analyzes the origination of such derogations in pre-1890 cases. Inter alia, the author found, that the issue of public figure privacy derogation at its earliest refers to a dictum held by Judge Parsons in Commonwealth v. Clap, dated 1808.
