Abstract

The author carries out in the article the comparatively-legal analysis of doctrines of administrative legal disputes in countries with the proclaimed democratic modes, an estimation of essence and nature of administrative legal disputes, investigates theories administrative legal disputes in foreign countries, and also analyses the development of the institute of administrative justice. It should be noted, estimating the features of organization and process of consideration of administrative legal disputes in different countries, that German and French legislative and legal practice moved up farther in all as compared to other European countries. Creation of the specialized courts as financial, social and other court bodies can fully consist in the legal doctrine of countries with the developed democracy. For creation of the specialized courts the public relations served by them must attain the certain quality level of development. This level must be determined by not only complication of public relations within the framework of that there are administrative legal disputes but also social meaningfulness of these relations among other relations of administrative legal type. The harmonization and unitization of the legal systems within the framework of European community require a development of some administrative legal concepts, not except and concept of administrative legal dispute and at international legal level.
