The expediency of unification and harmonization of conflict norms in international family law

Abstract

The article explores the expediency of developing harmonization and unification of conflict rules in international family law as the main trends of modern international family law and reveals their content. Harmonization or unification with the norms of international family law should not lead to full unity (identity). The author examines and characterizes the convergence of the norms of family law, both material and conflict, that occur at different levels and within different institutions. The author investigated how such harmonization of standards convergence of family law as the harmonization of family law in the European Union. The activity of such organizations as KYESP which initiated the harmonization of law in this area and continues to coordinate actions for its implementation, and given the results of the conference “Prospects for unification and harmonization of family law in Europe”, “Principles of European Family Law. Divorce, maintenance between former spouses and parental responsibility”. Active participants discuss the harmonization of family law is also a European association of women lawyers, the main subject of its activities is to study modern legal status of women. Another way to harmonize standards convergence is the work of the Hague Conference on Private International Law, under which achieved the most significant results in the unification of conflict rules in the field of family law through the three conventions. The author confirmed that the harmonization or standardization in view of international family law should not lead to full unity (identity). The harmonization of national legislation aimed at forming already agreed approaches to bringing national legislation into line with international treaties and decisions of the EU and its practice, the creation of the basis of common legal space within the EU.
