THE FIGHT AGAINST TERRORISM THROUGH THE PRISM OF THE UNITED NATIONS DOCUMENTS

Abstract

The main subject of this paper is the fight against terrorism through the prism of the United Nations documents. Given that terrorism is a regional problem, numerous international regional organizations have undertaken a series of activities to signify terrorism as a criminal offense for the suppression of which it is necessary to establish a uniform legal framework that would prevent the evasion of justice by going to another country whose national criminal legislation does not foresee punishment for certain conduct or narrowly defines it. The threat of terrorism in global security has seen the United Nations, through its decades-long activity, seeks to build effective and preventive mechanisms that involve a criminal element based on respect for fundamental human rights and freedoms and the principle of the rule of law. The need for an effective criminal justice response to terrorism involves the adoption and implementation of a series of documents aimed at preventing terrorist acts. Within the framework of this paper, the most important international documents adopted for the fight against terrorism by the League of Nations, as the forerunner of the United Nations, will be analyzed. Furthermore, international documents (mainly conventions) relating to the criminal-legal fight against terrorism will be analyzed in order for states to anticipate certain criminal offenses and sanctions in their national criminal justice legislation in order to create effective mechanisms for preventing and punishing criminal offenses terrorism. The purpose of these documents is to harmonize the criminal laws of the national states, and through the synchronized criminalization of terrorist behavior, the international cooperation of the state bodies competent for the prevention and suppression of terrorism will be facilitated. It is important to point out that although terrorism is the most difficult form of criminality, the criminal justice response to terrorism must respect the achievements of the criminal justice dogma in accordance with the democratic values accepted at UN, EU and Council of Europe levels, as well as in all constitutional democracies of member states.
