The idea and concept of local government in the political and legal thought of Ukraine in the early twentieth century

Abstract

The concept and conceptual basis of local self-government as an integral part of public governance in the political and legal opinion of Ukraine at the beginning of the XX century are analyzed. and the peculiarities of its application in modern state-building practice. The problem of local self-government in the interpretation of Ukrainian thinkers is aimed at getting rid of excessive centralization and self-regulation of the life of the Ukrainian nation (nation) on the basis of the principle of decentralization. Comparing two forms of democracy - a representative and direct democracy - thinkers of Ukraine preferred local self-government. We can say that by the beginning of the twentieth century. the representative form of democracy did not achieve practical implementation in Ukraine, but existed only in the form of ideas and doctrines, whereas the direct had some practical experience in the center (the Chamber, the Boyar Duma, the Cossack councils) and in the field (the community, the peasant stairs). Therefore, the doctrinal development of issues of local self-government, and not parliamentarism, has gained greater perfection in the writings of Ukrainian thinkers. And its traditional weight is felt in the present: in the legislative regulation of local self-government, and even in matters of improvement of parliamentarism, when the benefits of the introduction of bicameral parliament in Ukraine is considered to be the provision of the second chamber of representation of the regions. Bodies of local self-government were considered both as organs of the people's power and as bodies of state power.
