The impact of the application of judicial precedent on the formation of the national legal system in some European countries: theoretical and legal analysis

Abstract
The article deals with theoretical law analysis of problems of judicial precedent`s influence on national legal systems of some European countries. The author points out that comparing the role of judicial precedent in countries with common-law system and countries with civil-law system there are differences. The study lead to the conclusion that currently there is a tendency of unification of law systems: the role of enacted law in common-law systems is increasing, whereas civil-law systems start applying case law much more often.
