THE IMPLEMENTATION OF THE RULE OF LAW IN THE CONDUCT OF INVESTIGATIVE ACTIONS

Abstract
In 2012 as a result of the rule of law consolidation among the principles of criminal proceedings, have emerged new issues and problems, which require theoretical comprehension and scientific justification in the context of observance and maintenance of human rights in the conduct of investigative (search) actions. First and foremost, it is the identification of factors that serve to prevent the unjustified restriction of human rights and which ensure criteria for observing the rule of law in conducting investigative actions. The article provides an analysis of the scientific developments related to the production of investigative (search) actions and observance of rights and freedoms of the criminal process participants. This paper has attempted to analyze the rule of law implementation when investigative (search) actions.
