The Independent Investigations Office in the criminal proceedings

Abstract
The article highlights the challenges of improving protection in the implementation of the principle of the adversarial principle, the establishment of the Institute of criminal defender investigation law of Ukraine, international legal precedent, an actor of the practice of the European Court of Human Rights and other European standards. Recovery Institute litigation attorneys in modern national legislation will be productive for legal science and law practice. The competence of the attorneys it is advisable to include the performance of the functions of protection in judicial proceedings. The pre-trial investigation will perform the protection of professional lawyers-attorneys who would powers of independent legal investigation. According to the current legislation of Ukraine Defender enjoys procedural rights of the suspect, accused, in addition to procedural rights, the implementation of which is carried out directly by the suspect, the accused. Is displaying the authority limits the exercise of the function of protection. Defender to present separately specified the rights and powers that could guarantee and ensure the effective implementation of the protection feature.
