The issue of legal regulation of port activity

Abstract
In this article, the problem of improving the legal regulation of the peculiarities of the ports activity and control systems implemented in them is considered. Attention is drawn to the subjects of the port activity both in terms of their legal status and organization of their functioning. The scientific research of legal provision of management systems used in seaports including European and world practice and Ukrainian legal bases on port sector reform and activity of port operators is conducted. The concept of organizational and legal peculiarities concerning ports in general and port operator (stevedore) as a subject of port activity – and a port terminal as an object of port activity is defined. The generations of ports are distinguished and described, their characteristics are given. The organizational and legal models of port management and port activity processes are determined. The port operator and its functions are determined. The authors draw attention to the subjects of the port activity both in terms of their legal status, and the organization of their functioning. Practical experience of port operator's activity at the national and European level is integrated. The research on the management methods in the port industry, which should be carried out based on the provisions of the legal framework for port reform in Ukraine is carried out. The author concludes that the improvement of maritime legislation requires the most attention regarding the legal regulation of port management systems and the activities of port operators.
