The nature of deceit and fraud in contracts from the standpoint of Iran law

Abstract

Fraud to the law is legal in itself but with the intention of evading the law is mandatory or preventive. Fraud means evading from law with the internal or external competency along with voluntary changes of dependency elements such as citizenship and residence. Present study under the title of deceit and fraud nature from the standpoint of Iran law by using descriptive- analytical investigate deceit in contracts. The main question is how is the domain of criminal and civil jurisdiction deceit? The claim of this research is that range and effect of criminal deceit is more limited than civil one. Results show that: that range and effect of criminal deceit is more limited in terms of kind and goal than civil deceit one. Silence, leaving the act and lie in case of not be along with show, it is not sufficient in performing criminal deceit, however they can be regarded as civil deceit and cause to "Khiar". Effect of criminal deceit is more and broader than civil one.
