THE PROBLEMATIC ISSUES OF ENFORCEMENT PROCEEDINGS’ CHARACTERISTICS

Abstract
The article has researched the main approaches to identifying the enforcement proceedings in the legal science, examined the problematic issues of representation of enforcement proceedings that derive from the provisions of the first section of the law “About enforcement proceedings”. It has examined the practical aspects of the implementation of judgments of the European Court of Human Rights, which are connected with enforcement of judgments, and analyzed the value of judgments, that directly refers to the approaches of understanding the core of enforcement proceedings. According to it, in this article the author is trying to research the interrelationship between enforcement proceedings and judicial proceedings, and, as a result, identify the most efficient model of enforcement proceedings in Ukraine.
