THE QUESTION OF THE ESSENCE OF THE RIGHT TO INVIOLABILITY OF THE DWELLING IN THE CRIMINAL PROCEEDINGS

Abstract
The theoretical question of the essence of the right to inviolability of the dwelling in the criminal proceedings are investigated. Analyzed the literature on constitutional law, theory of law, criminal procedural law to determine the nature of scientific categories "providing subjective rights", "a mechanism for providing subjective rights" and their subsequent comparison. Based on the above analysis suggested on understanding the essence of the right to inviolability of the dwelling in the criminal proceedings. Formulated scientifically based proposals on the basis of the analysis.
