THE RIGHT OF WITHDRAWAL IN DISTANCE SALE CONTRACT

Abstract
The right of withdrawal seeks to protect the consumer in the particular situation of distance selling, where he is unable to see the product in a concrete manner or to appreciate the nature of the service provided before the conclusion of the contract. The right of withdrawal is intended to offset the disadvantage resulting for the consumer from a distance contract by giving him an adequate period of reflection during which he is able to terminate the contract unilaterally without any additional penalties and costs without invoking any reason. Due to its importance, the right to withdrawal is regulated very carefully not only by the Civil Code, but also by other special laws recently adopted.
