THE RIGHT TO PRIVACY AS THE BASIC HUMAN RIGHT

Abstract
The article analyzes the peculiarities of the right to privacy in the historical and comparative context as the fundamental human right. The guarantee of the right to privacy in the countries of continental Europe in the general rule is through constitutional consolidation. At the same time, the experience of such countries as Germany or France proves the great role of judicial practice and legal doctrine in safeguarding this right, which is deduced from other constitutional provisions.
