THE RIGHTS OF AN EMPLOYEE AS A SUBJECT OF PENAL PROTECTION

Abstract

Irrespectively of the results provided for in the provisions of the labour law and the civil law, mobbing leads to penal consequences both in case of the offender and the employer. Such acts can fulfil the features of some offences and petty offences. Penal measures influence the area of social relationships mainly through the norms. At this point one should consider whether personal interests in employment relationships are adequately protected by the indicated provisions of the penal law.<br/><br/>
