THE ROLE OF LEGAL CONSCIENCE IN DEVELOPMENT OF CREATIVE AND DECLARATORY PRECEDENTS OF ENGLISH LAW

Abstract
The article investigates the nature of consciousness in creative and declaratory precedents of English law. Argues that the creative precedents of the role of legal psychology plays a crucial role when creating declaratory – secondary. Consider mechanisms for obtaining the judges of new knowledge regarding the content of case law.
