The Role of Options in Classic Contracts and Electronic Contracts

Abstract
World Wide Web has proposed opportunities and concerns to human society and Islamic countries. E-commerce, is one of the outcomes of this surrounding network, which led to new jurisprudence and legal concerns, which demands for appropriate response of jurisprudents and lawyers. The issue of an internet contract cancelation in electronic pathways after its signing, could be proposed. Contract cancelation has several approaches, which among them, the cancelation with intention is one of the parties, named abolition, and this authority is called option. Since the basic principal of option realization is no-loss principal and its aim is to avoid loss of both parties; so in electronic contracts which contract parties are more exposed to loss resulting from contracts, due to special characteristics of this contracts such as virtual nature and lack of trade item visit, and arbitraries are more important. What is the significancy referring to the point that global rules and regulations of option are in the same way that for both the demonstration approach in electronic concept is different. In this article we examine option situation in classic contracts and electronic contracts, using library and descriptive method.
