THE SIMILARITY OF TRADEMARKS WITH OTHER TRADEMARKS AS A GROUND FOR REFUSAL IN LEGAL PROTECTION

Abstract
This paper examines the theoretical and practical positions one of the grounds for refusal of legal protection of trademark, alleged similarities to register the designation of other brands. Characterized criteria for determining similarity depending on the type of representation designation. Author position supported by material of judicial practice and guidelines regarding the examination of trademark applications.
