TO THE QUESTION OF CANCELLATION OF PROCEEDING DECISIONS AS CONSEQUENCES OF NON-COMPLIANCE AND VIOLATION OF THE PRINCIPLES OF CRIMINAL PROCEEDINGS

Abstract
In the article questions of cancellation of proceeding decisions as consequences of non-compliance and violation of the principles of criminal proceedings are investigated. It is established that legal responsibility which arises owing to adoption of the proceeding decision with non-compliance and violation of the principles of criminal proceedings is right recovery in character, has the legal and actual grounds. Further development of the system of essential violations of requirements of the criminal procedural law in a form of non-compliance and violation of the general principles of criminal proceedings as the bases for cancellation of proceeding decisions is recognized as the perspective direction of development of science of a penal procedural law.
