TO THE QUESTION OF VALIDITY OF THE EXPLANATION IN CRIMINAL TRIAL OF RUSSIA

Abstract
The article gives an analysis of practice of use of an explanation as the proof on criminal cases, the opinions which are available in the Russian criminal procedure science concerning validity of the explanation received during verification of the message on a crime are considered. As a result of research a conclusion on the need of legislative fixing of an explanation as an independent source of the proof is formulated.
