Transferability and protectability of property rights on industrial property objects: relationship of concepts.

Abstract
The article is devoted to research of relationship between concepts of transferability and protectability of property rights on industrial property objects. Content of concept of legal civil circulation is researched. Influence of patentability of inventions, utility models, industrial designs and topographies of integrated microcircuits on procedure of property rights origination as well as on issues of spreading legal patent protection over such rights is determined. Legal role of patent in legal circulation of property rights on industrial property objects as well as its legal effect is analyzed. Right of prior use and subsequent use of industrial property objects as untransferable property rights that arises out of factual use of such an objects without its legitimation are researched. Relationship between concepts of transferability and protectability of property rights on inventions, utility models, industrial designs and topographies of integrated microcircuits are determined.
