TRANSPORT SAFETY OF THE STATE AS COMPONENT PART OF A NATIONAL TRANSPORT POLITIC

Abstract

Problem setting. Ukraine has an unique geographical location on crossing of transport streams from Europe to Asia. By advantage for development of a transport industry and economies on the whole are presence of the system of ports, developed system of railways and motor-car ways, pipeline system and others like that. Target of research. The purpose of this article is determination of legal nature and maintenance of category is a «transport safety» in the context of consideration of her as a component national transport politics. Analysis of recent researches confirms that the issue of transport security practically hasn’t been studied by scientists yet. Thus, a study on the development of transit potential of the state has been carried out by A. M. Novikova, K. M. Mykhailychenko, E. V. Belashov, T. P. Luchnikov, S. S. Shapoval, T. O. Voichenko, D. K. Preyhera, A. M. Hahlyuk and others. There some researches in the national economic security field, for example, scientific works of E. M. Belousov, G. O. Puhtayevych, V. K. Senchahov, O. O. Belkov, Yu. I. Vladimirov, L. I. Abalkina, V. O. Savina and others. The issue of transport security in economic terms considered in the works of I. M. Averikov and O. Sapronov. Article’s main body. Transit potential of the state is used only on a fourth, quality of transport services is subzero enough, and that exactly more main all - there are substantial threats as to safety of transportations. Without regard to the real demand, in science complex legal researches are now absent in relation to the origin of new calls and threats to a national transport system and, in particular to her infrastructure and subjects, and also the questions of legal regulation of a transport safety of the state were not examined. The analysis of legislation in the field of a transport and analytical materials gives all grounds to assert that a transport safety contains such signs: – sent to defense of interests of the state and society, separate citizens; – envisages the corresponding state of a national transport system and legal mechanism of realization of public policy in the field of it; – is the component of economic security of the state, as only due to work of a transport industry basis of economy of the state – trade becomes possible. Suggest defining a national transport safety as such development of a transport system of the state, at that balance of interests of the state, society and separate citizens, and also defense of their interests, is provided in case of origin of internal and external threats status. Conclusions and prospects for the development. On the modern stage of community, development to the problem of determination of threats and calls to a national transport safety of Ukraine small attention is spared critically both at legislative level and at the level of fundamental science. However, actuality of this subjects causes denials.
