Abstract
The article discloses the specifics of the legal status of the defender in the criminal proceedings, the provisions of the legislation, its regulating. On the basis of the analysis of scientific sources and domestic legislation, as well as the practice of its application, the author has attempted to investigate problematic issues related to the involvement of counsel for participation in criminal proceedings and the exercise of his procedural rights in criminal proceedings. The article considers on the legal nature and social significance of protection as an obligatory element of the resolution of legal disputes in court, the construction of which meets the controversial requirements. It is established that the legal nature of the participation of the defender in criminal proceedings consists of the constitutional human right to defend himself personally or to benefit from the legal assistance of the defender. In cases stipulated by law, such assistance is provided free of charge.
