UNDELEGATED RIGHTS WITHIN THE STRUCTURE OF CRIMINAL PROCEDURAL STATUS OF THE ACCUSED (CRIMINAL DEFENDANT) UNDER UKRAINIAN LEGISLATION

Abstract
The author of the article studies the issue of the extent of inalienable personal procedural rights of the accused (criminal defendant) that has not been regulated in the criminal procedural legislation of Ukraine, which can only be realized by him directly. The author has stressed the negative impact of this gap in the law on the legal regulation of the procedural status of both the accused (criminal defendant), and other participants in criminal legal proceedings, whom the legislator delegates his rights, in particular, the defence counsel, the legal representative of the accused (criminal defendant) and others. The author has made an attempt to single out undelegated right from the set of procedural rights of the accused (criminal defendant), the implementation of which can not be entrusted to other participants in the criminal procedure.
