“UNPATENTED INVENTION” AND “KNOW-HOW”: CORRELATION OF CONCEPTS

Abstract
The article is devoted to the analysis of the concepts of “know-how”, “invention”, “utility model”, the distinction of knowhow from unpatented technical solutions is considered, as well as ways to dispose of property rights to these objects. The legality of the use of the concepts of “unpatented invention”, “unprotected invention” is analyzed. The methods of protection of technical solutions are investigated. The author’s position on the peculiarities of the protection of the results of technical creativity is highlighted and the criteria of their attribution to certain objects of intellectual property rights, in particular to know-how, inventions and objects of copyright, are offered.
