USING THE FBI'S EXPERIENCE WITH THE ORGANIZATIONAL AND LEGAL ENSURING OF ANTI-CORRUPTION IN THE PUBLIC SECTOR DURING THE PERFECTION OF THE ACTIVITY OF THE NATIONAL SPECIAL SERVICES

Abstract
This article formulates approaches to using the experience of the FBI in the organizational and legal framework for combating corruption in the public sector while improving the activities of the domestic special services, including in the formulation of tasks and areas of its activities. In particular, the organizational and legal support of the activities of the special services of European countries was analyzed and it was stated that the tasks and powers in the sphere of combating organized crime have internal security services. It is the organizational and legal structure of the FBI, namely its components related to ensuring the fulfillment of the anti-corruption task and the fight against organized crime is considered the best model for reforming the Ukrainian special services. The classification of the majority of offenses dealt with by the FBI has been carried out and the main and most threatening types of public sector corruption in the US have been examined in detail in terms of ensuring the national interests of the state. The author has formulated certain approaches to the reform of the Security Service of Ukraine, including the requirements for the functional load of the special units to combat corruption and organized crime of the Security Council of Ukraine. It was concluded that most of the functional tasks of the Security Service of Ukraine, as well as its competences and powers, are mainly attributed to the investigative nature of the crimes, which are investigated by security investigators, indicating a certain identity to similar tasks facing the FBI. The latter only confirms the thesis that the positive experience of the organizational and legal support of the FBI activities in the field of combating corruption in the public sector can be used to determine, concretize and detail the Ukrainian special service, in the course of its reform, its own current and future powers, their scope and content in the areas of combating corruption and organized crime. In addition, the article contains proposals for the protection of the national interests of the state, the welfare of the country and the proper maintenance of the rights and freedoms of its citizens, taking into account the difficult criminal situation, complicated by the difficult economic situation, political instability and military conflict in the east of the country and etc.
