Valuable and legal features of legally meaningful behavior
Journal Title: Naukovyy Visnyk Dnipropetrovs'kogo Derzhavnogo Universytety Vnutrishnikh Sprav - Year 2018, Vol 1, Issue 1
Abstract
The author analyzes the main valuable and legal features of legally meaningful behaviour of a person, a certain type of its legal position, which performs the function of managing legally significant actions. They include: sense of responsibility, solidarity with law, justice, legality, legal duty, and respect for the law. It is noted that behaviour, which is a part of legal regulation, may be caused by the action of other social regulators (in fact, we are talking about the implementation of the rules of morality, religion, etc., but not the rules of law). However, this factor does not change the characteristics of behaviour – it retains a feature of lawfulness. The peculiarity of lawful behaviour is determined by such features: compliance with the norms and principles of law (lawfulness); social utility or admissibility. It is concluded that any legally meaningful behaviour of the subject of legal relations is legal, since it is regulated by the norms of law and gives rise to legal consequences. It is a form of freedom of the person, his/her personal expression, professional or other activity in the state. There are no legal relations in the society and the state without legal behaviour, individuals would not be able to exercise their rights and freedoms as citizens of the state. Legal behaviour is a legal fact that determines the nature of the behaviour of subjects of legal relations.
