VIOLATION OF APPOINTMENT AS GROUNDS FOR DISQUALIFICATION IN COMMERCIAL PROCEEDINGS

Abstract
The article is dedicated to the problematic issues related to in the ’institution of challenge’ in the procedural law of Ukraine. The author analyzes and compares the key provisions of the laws of Ukraine in the field under investigation, as well as assesses the extent and mechanism of their implementation in the laws of Ukraine. The author would like to emphasize the need for mandatory elimination of defects, discovered in the course of exploration of the institute of legal rules embracing the concept of recusation in the procedural law of Ukraine.
