PERSPECTIVES OF CREATION INSTITUTE OF PRIVATE EXECUTORS AS PART OF LEGAL STATE

Abstract

This article analyzes the private executor institute introduction prospects in Ukraine, establishment of positive and negative aspects of the implementation and its influence on the real state of implementation of judicial decisions. A problem of the creation of an alternative model of enforcement of judgments has been reviewed. Implementation of the institute of private executors will have a positive effect on the performance of execution as a result of having a material interest in the effectiveness of the executor, presence of competition between private and public executors, which will raise the level of quality of services. Also, largely the state executive service will be uploaded, which will allow promises to focus more effective on the category of cases referred to the exclusive competence of the state executors. Implementation of the institute of private executors based on the use of foreign experience and experiences of the private notary system implementation in Ukraine will avoid extended ones mistakes in the process of implementation and enter the high levels in the work in a shorter period. Also consider global enforcement system, investigated the system of enforcement of judgments of countries in which the private Institute executor introduced.
