SOURCES OF INTERNATIONAL LAW IN THE ACTIVITIES OF MODERN INTERNATIONAL CRIMINAL TRIBUNALS

Abstract

The article describes a law applying aspect of work of the International Tribunal for the former Yugoslavia, the International Tribunal for Rwanda and the International Criminal Court. The author examines the law used by the courts and allocates the sources of international law to which they apply when deciding on a case. The sources that provoke the greatest number of questions are international customs, general principles of law, and judicial decisions. The study emphasizes law-making function of judges of international criminal tribunals. The specificity of the normative array, which regulates the relationship in the sphere of international criminal law, makes it possible to refer it to a special (self-contained) regime in international law.
