Violation of the fair resolution principle in recruitment procedures for the positions of managers

Abstract

The right to receive an impartial ruling from the relevant authorities is a good indicator of the non-discriminatory conduct and an objective set of assessment criteria having been exercised during a legal hearing. The chances of obtaining even-handed outcomes to disputes are greatly increased by according the Charter of Fundamental Rights with the status of a treaty. Regarding this well-founded requirement of unbiased procedural comportment, Article 41 succinctly states that everyone has the right to a fair hearing, carried out over a reasonable time-scale, by the numerous institutions, bodies, offices and agencies of the European Union. The principle of impartiality is one of the constitutive antecedents of an individual’s right to expect good administration. This takes on greater significance when dealing with matters concerning the formulation of an individual’s social standing and their various personal entitlements – in particular when it comes to the question of more extensive intrusion into an individual’s rights and liberties. The aim of this work is to focus on the issue of infringement of the impartiality principle in the selection process for managerial positions. The wide range of discretionary powers, such as those at the disposal of competitive selection bodies, which are similar in nature to recruiting commissions, should be counterbalanced by the absolute compliance – on the part of the both authorised and obligated institution – with the regulations aimed at ensuring the fair organisation of such proceedings.<br/><br/>
