ВИРІШЕННЯ БІОБАНКАМИ ЮРИДИЧНОЇ ДОЛІ БІОЛОГІЧНИХ ЗРАЗКІВ

Abstract
Today biobanks are the important elements of the health care system. Biobanks collect human biological material not only for therapy but their collections are the unique source for biomedical researches. As a rule biobanks are established for long-time period. However some reasons can course termination of biobank such as insufficient funding, change of leadership, etc. The paper explores the problematic aspects of biobank termination and the effect of biobank termination for the collections of samples. The author analyzes the national and international legislation for the termination of the biobank operation and concludes that there is a need for legislation to achieve a balance between ethics and law in order to ensure the donors rights.
