ВОПРОСЫ ФОРМИРОВАНИЯ СИСТЕМЫ ИСПОЛНЕНИЯ НАКАЗАНИЙ В АППАРАТЕ ПУБЛИЧНОЙ ВЛАСТИ

Abstract
В статье анализируются некоторые аспекты формирования системы исполнения наказаний в аппарате социальной и публичной власти. На основе использования историко-правовых методов, ретроспективного метода, методов анализа и синтеза рассмотрена социальная суть наказания в период Средневековья и становлення буржуазного общества. Автор представляет систему исполнения наказаний в неразрывной святи с апаратом социальной (публичной) власти. Проанализированы с использованием историко-сравнительного метода две паралельно существовавшие альтернативне государственно-правовые системы наказания – светская и религиозная.
