Warranty liability of investor in the investment process

Abstract
The subject of this article is an analysis of the legal basis regulating the range and the conditions on giving rise to the passive, joint warranty liability on the side of the investor. The above mentioned issue is set in context of the concept of social liability of entrepreneur aimed at protecting the public and specific groups of stakeholders interest. The range of discussed issues successively includes: 1) the definition of the limits of the investor liability concerning the obligations arising from the agreement concluded between the contractor (general contractor) of construction works and a subcontractor, 2) the analysis of the conditions determining the development of the warranty liability on the side of the investor, including requirements relating to granting the consent by the investor to the conclusion of the agreement by the contractor with a subcontractor, 3) the principles of the investor joint liability in respect of the obligations resulting from the agreement concluded between the subcontractor of construction works and further subcontractor. The performed analysis is to determine the practical conditions forming the position of the investor as a special guarantor of correct individual relationships as part of the investment process. The conducted considerations were based on the jurisdiction of common courts of law influencing the interpretation of the rules regulating the discussed topics.
