ЗАГАЛЬНОЄВРОПЕЙСЬКА МОДЕЛЬ СУДОВОГО ЗАХИСТУ КОЛЕКТИВНИХ ПРАВ ТА ІНТЕРЕСІВ СПОЖИВАЧІВ

Abstract

In the scientific article the essence and procedural peculiarities of the proceedings in the case of representative actions concerning the protection of collective rights and consumer interests as a pan-European procedural mechanism of collective compensation are researched. A representative case may be brought by qualified institutions for the protection of the rights and interests of two or more persons whose rights and interests have been violated or there is a risk of their violations, and the individuals themselves are not directly involved in the proceedings. The outcome of the trial of such a claim may be a court decision prohibiting or terminating the actions of the defendant, violating the collective interests of consumers, as well as a decision on compensation for harm to interested consumers as a result of illegal actions of the defendant. Representation is considered as a typical group action adapted to the features of the continental legal system, which ensures effective and timely access to justice for all stakeholders. The author noted the procedural peculiarities of the trial on a representative action: the lack of the need to provide individual consumers with mandates for representation in court of their interests; special properties of the final court decision; suspension of the limitation period for individual consumer claims for damages; limitation of court fees; prohibition of punitive damages; definition of the circle of interested consumers on the principle of “opt-in”; the establishment of fines as a means of ensuring compliance with the decision on representative claims; stimulating the parties to the settlement of the dispute. The conclusion is made on the necessity of developing the institute of class (representative) action in the civil procedural legislation of Ukraine taking into account the perspective legislation of the European Union.
