Zdatność arbitrażowa sporów w Stanach Zjednoczonych Ameryki

Abstract
Arbitrability in American legal systems differs in many aspects from the continental definition of this term. It is much broader. It seems as if the American non-arbitrability is the equivalent to continental arbitrability in its negative aspect. There is lack of a unified definition of arbitrability in the USA. In general, it is divided into substantive arbitrability and procedural arbitrability. As a result of several judgments of the Supreme Court of America, the term gateway procedural issues has arisen. Problems with the definitions have their practical impact. Of the utmost importance is the answer to the question – who decides on arbitrability issues, courts or arbitrators?
