A DEFINITION AND FEATURES OF PUBLIC-PRIVATE PARTNERSHIP

Abstract

The article addresses the legal notion of PPP as cooperation between public and private partners as an agreement that corresponds to the fixed in law characteristics – object transfer to the private partner management, also transfer of risks to them, long-term relationships, the private partner investment to the project. As the author studied the positions of both scholars and practitioners, as it is the need to refine the concept and characteristics of PPP. Firstly, it is needed to be supplied with the understanding of PPP as a socially significant institution. Secondly, the targeted nature of PPP should be paid attention to. Thirdly, the need to protect the rights of a private partner in risk management is also ought to be considered.
