A REGULARIZAÇÃO DAS TERRAS DEVOLUTAS NA FAIXA DE FRONTEIRA: O CONFLITO JUDICIAL DA FAZENDA OCOY

Abstract

This article is the result of a research that is being conducted on the factors that promoted the expropriation of Ocoy farm in 1971, for the interdisciplinary master’s in Society, Culture and Borders of UNIOESTE, Foz do Iguassu’s campus in Parana. And has as main goal, to perform a historical analysis of the implementation of the Brazilian land system and the settlement of vacant lands, especially those situated along the border that resulted in domain disputes for these lands between the State members and the Union. To better understand this dispute, the legal institutionalization of the dividing range, which covers 66 miles and the national security zone that range today 66 km to 150 km will be discussed. And from these discussions, the legal conflict on the compensation to the expropriated from Ocoy farm due to the expropriation of this rural property will be examined. And the justifications substantiated by the Supreme Court of Justice -STJ, which based on the law of the land rights, decided not to comply with the required payment of restitution, diverging from the Federal Regional Court of Justice of the 4th region of Porto Alegre. This research has used literature sources on the subject and documentary regarding the legal reports relating to indemnification issue.3).
