Адаптація законодавства України у сфері протидії незаконному обігу зброї до законодавства ЄС / Approximation of Ukrainian Legislation Regarding Combating Illicit Traffic in Firearms to EU Laws

Abstract
The article dwells on problems of Adaptation Ukrainian legislation to combating illicit trafficking in firearms and other weapons to the European Union laws and international legal standards. This becomes topical as some provisions of national legislation have not been harmonized with international legal acts ratified by Ukraine, and thus, are to be adopted to current EU norms. Ukraine, assuming such commitments, had to take a number of measures to implement them, the first of which was to legislate the normalization of the circulation of weapons that would meet the requirements of the European Community. Instead, we are forced to state that the settlement of such a socially significant and reputable international issue is currently being carried out by a departmental normative act. Harmonization of the legislation of Ukraine with the EU legislation implies a waiver of the existing concept of regulation of public relations in the sphere of arms circulation, its components and ammunition to it, with the help of departmental normative acts of the Ministry of Internal Affairs. The need is obvious in the relevant law. However, the existing projects to date do not fully meet the modern European requirements, which determines the development of a new draft legislative act, which should be based and take into account the provisions Model Law against the Illicit Manufacturing of and Trafficking in Firearms, Their Parts and Components and Ammunition UN.
