Analyzing Donation Contract in Iran Legal System

Abstract
Donation in word is meaning donating without exchange and in Imamiye's views it has got two meanings: General & Particular, Donation in general meaning it is property without exchange. Donation in mentioned meaning comprised of prize, donation and goodness. Donation in particular it means from article (795) civil law one gives prosperity without exchange to others. One who gives the property is donator and other one is donate. The prosperity which is the subject of donation is called donation subject. Islamic lawyers call donation as prize. The donation in addition to being free or by exchange and in some positions the donation it is not by exchanging with donator property and the donation is free. In fact on condition donation is a mixture of two kinds of donations which one of them is opposite the other and the mentioned contract is such other contracts like rent or selling by exchange.
