Analyzing Intensive Punishment of Lash in Adultery Deserving Murder and Stoning

Abstract
According to the Islamic Jurisprudence and consequently Islamic penal code (Islamic punishment law) one of cases of lash punishment in the crimes that are against purity is adultery. But one of the cases that is open to disputation in this regard is the fact that in adultery opted to murder and adultery opted to stoning the question is that whether adulterous before suffering a specific punishment, murder in first case and stoning in the second one should suffer one hundred lashes or additional lash punishment is not deserving them in these two cases. In this article we analyze the Jurisdictions ideas and reasoning dispute on the ideas of legislation. The main finding of this research is that the precise interpretation of law states that in adultery opted murder and based on the laws by legislation only the murder punishment is applicable and in spite of prediction of article 84 Gh. M.A adultery with married women lash punishment should not be applied before stoning and consequently in both cases specific punishment is suffice.
